Before a Deed is prepared, I will discuss the different types of Deeds that I can prepare. For example, a Lady Bird Deed can be used to avoid Probate. The owner can retain all the rights and exemptions during their lifetime. A Deed to a child or parent as joint tenants with the right of survivorship can entitle a child or parent to homestead exemption. When Real Estate is gifted it may require documentary stamps be paid based upon the balance owed on the mortgage, even if there is no money being paid by the recipient of the Real Property, Documentary stamps do not need to be paid if the property is the owner's homestead, and the Deed is being signed as a result of a divorce or marriage. Deeds must be signed in the presence of two different witnesses and notarized.
