Foreclosure and Foreclosure Defense
If you receive a summons, you have 20 days to file a response to a foreclosure lawsuit. You should call and set an appointment with my office as soon as possible to discuss your options. These options include selling the property, reinstating the mortgage, modifying the mortgage, giving the property to the lender (Deed in Lieu of Foreclosure), filing a defense to the foreclosure action. The foreclosure process takes 6 months or more to complete if you do not file a response to the foreclosure lawsuit. When you retain my office to defend the foreclosure lawsuit, the process usually takes much longer. You have the right to stay in your home until the property is sold a foreclosure sale and a successful bidder obtains title and a Writ of Possession. You may sell your property any time before the property is sold at the foreclosure sale.
