Contract Disputes
The first step when resolving a contract dispute is to read the contract to see if the problem is addressed in the contact. A contract may require the parties to mediate the dispute, arbitrate, or litigate. When buying or selling residential Real Estate, a lawsuit is not a good option because of the time and cost of attorneys. My approach to resolving these disputes is to involve the buyer, seller, and Realtor in the solution. The buyer wants to buy real property, not a lawsuit and the seller wants to sell real property, not be tied up with litigation. If all parties keep these goals in mind, my experience has shown most problems can be resolved and the purchase and sale transaction closed. My advice is to attack the problem and do not attack the party or attempt to place blame as to who caused the problem.
