Durable Power of Attorney

A Power of Attorney designates an agent to act on your behalf. Durable Powers of Attorney are often used by your agent to sell Real Estate as well as transact other business for you. A Durable Power of Attorney authorizes an agent to act in your best interest. The agent should not engage in self-dealing to benefit themselves. A Durable Power of Attorney is effective as soon as you sign the document. If you become incapacitated, the Power of Attorney can still be used and is often the reason why clients sign a Durable Power of Attorney as part of their Estate Planning. A Durable Power of Attorney can give your agent the right to do Medicaid planning, make gifts on your behalf, handle your IRA, and handle your 401K.
